Tree Regulations

The six
members of the Nebraska City Tree Board are responsible for studying,
investigating, counseling and developing a written plan for the
care, preservation, trimming, planting, replanting, removal or disposal
of trees and shrubs in parks, on public right-of-ways and in other
public areas.
The city
retains the right to plant, prune, maintain and remove trees,
plants and shrubs within the lines of all streets, alleys, avenues,
lanes, squares and public grounds in order to ensure public safety
or preserve and enhance the symmetry and beauty of the grounds.
Trees, plants
and shrubs on private property are the owner’s responsibility
and must follow the ordinances set by the city of Nebraska City.
It is unlawful
as a normal practice for any person, firm or city department to
top any street tree, park tree or other tree on public property.
Topping is defined as the severe cutting back of limbs to the
stubs larger than three inches in diameter within the tree’s
crown to such a degree so as to remove the normal canopy and disfigure
the tree.
Trees severely
damaged by storms or other causes or those under utility wires
or other obstructions may be exempted from this requirement based
on recommendations from the tree board.
The branches
of any trees adjacent to any sidewalk must be trimmed to the height
of eight feet above the sidewalk. The limbs or branches extending
over sidewalks must never interfere with the lighting of the streets
or public passage on the sidewalk without the risk of council
action. The property owner bears the cost of removing any such
obstacles.
The city
also retains the right to remove any dead or diseased trees on
private property within the city when the trees constitute a potential
threat to other trees within the city.
The tree
board will notify property owners who need to remove trees from
their property. Removal must be done by owners at their own expense
within 60 days after notification is received. If owners fail
to remove the designated trees, the city will remove them with
the cost of the removal to be recovered in the name of the city
or assessed as a special taxation.
No trees,
vines, flowers or shrubs can be planted on the corners of parking
spaces at street intersections between sidewalks and curbs.
Planting
trees at the corners of intersections is prohibited. All trees
planted in parking spaces must conform in line with the majority
of trees already planted in the blocks. If no trees are planted
there, the new trees should be planted an equal distance from
the sidewalk and curb. No more than two trees shall be planted
to one lot in such a parking space.
It is unlawful to interfere with any member of the
tree board while they are planting, cultivating, mulching, pruning,
spraying or removing any street trees, park trees or trees on private
grounds.
